Sawra Realty Terms & Conditions Checklist & Structure

1. Rules for Use & Affiliate Platform Conduct

• Independent Marketing Channel: Associates and Sales Promoters operate as independent affiliate promoters, sharing official property marketing materials across digital channels.

• Lead Submission Process: All client inquiries, contact numbers, and buyer requirements must be submitted directly to customer support for company-managed follow-ups and site visits.

• Authorized Channels: Promoters are authorized to post approved banners, videos, and updates on WhatsApp Status, Facebook, Instagram, and YouTube.

• Prohibited Practices: Strict ban on misrepresenting property rates, promising assured market returns, or collecting cash directly from customers on behalf of the company.

2. Compensation, Commission & "No-Recruitment-Fee" Policy

• Zero Earning on Recruitment: No commission, bonus, or income is payable solely for recruiting, registering, or building a team.

• Sales-Contingent Payouts: All direct commissions and multi-level team overrides (Levels 1 to 10) are released exclusively upon the successful execution, payment clearance, and legal registration of an actual property sale.

• Per-Unit Calculation: Commissions are calculated on a per-square-yard basis according to rank and designation (from ₹100/sq. yd up to ₹1,000/sq. yd).

• Pool / Club Income: SP, RSP, and BGP club revenue distributions require meeting monthly active criteria (e.g., minimum 25 active promotional days per month) along with actual verified sales.

• Tax Deductions (TDS): All disbursements are subject to applicable statutory deductions (TDS) under prevailing tax laws.

3. Data Protection & Privacy

• Client Lead Confidentiality: Complete confidentiality of buyer personal information, contact numbers, and site inspection schedules.

• User Credential Protection: Protection and restricted access to individual affiliate portal accounts and performance dashboards.

• Communication Consent: Promoter consent to receive operational alerts, meeting invitations, and business announcements via SMS, WhatsApp, and email.

4. Payment Terms & Refund Policy

• Registration Fee: Specification of the ₹500 one-time fee for Sales Promoter account activation.

• Non-Refundable Activation: The ₹500 platform activation fee is non-refundable.

• Property Booking Advance: Buyer token/advance payments are governed by standard developer booking agreements and cancellation policies.

5. Termination & Account Suspension

• Inactivity Terms: Failure to fulfill participation conditions (such as attending required meetings or maintaining active status) will impact club income eligibility.

• Immediate Termination Grounds: Submitting fake leads, defaming the brand, misrepresenting the business as an investment/pyramid scheme, or engaging in unauthorized cash dealings.

• Forfeiture on Termination: Immediate cancellation of active ranks, login access, and non-cleared pending bonuses upon formal suspension.

6. Liability Disclaimers

• Independent Contractor Agreement: Affiliates are independent channel partners and do not hold employee, partner, or agency relationships with Sawra Realty.

• No Guaranteed Earnings: All projections and income charts presented in growth plans serve purely as illustrative examples based on successful sales volume.

• Real Estate Market Disclaimers: Property development timelines, title registrations, and government approvals remain subject to statutory authorities and master planning rules.

7. Miscellaneous & Dispute Resolution

• Rank Hierarchy: Rank progressions (RSP, BGP, RBGP, DBP, Director, National Director) define eligibility for upgraded per-square-yard commission rates on future sales.

• Right to Amend: Management reserves the authority to modify marketing materials, rank qualification metrics, and commission scales.

• Governing Law & Jurisdiction: All agreements, disputes, and legal interpretations fall strictly under the exclusive jurisdiction of the courts in Jaipur, Rajasthan.
